By replying with #YesSubaruCanada and/or posting with the Subaru Canada, Inc. (“Subaru Canada”) campaign/event/advertised hashtag you are confirming your agreement to the Terms and Conditions set out below. If you do not agree to these Terms and Conditions, you must not submit your Content. You should print or digitally save a copy of these Terms and Conditions for future reference.

Terms and Conditions

You grant to Subaru Canada a nonexclusive (meaning you are free to license your Content to anyone else in addition to Subaru Canada), royalty-free and without compensation to you (meaning that Subaru Canada is not required to pay you or anyone else deriving rights from you for the use of your Content), world-wide (because the Internet and the social media are global in reach), perpetual, transferable and sub-licensable (so that Subaru Canada’s affiliates, dealers, contractors and business partners are also able to Use the Content) right and license (but not the obligation) to Use (defined below) your Content, in whole or in part, in any form or media, including without limitation, Subaru Canada operated websites and social media channels (collectively, the “Subaru Sites”), without any notice or duty to account to you. Subaru Canada does not claim any ownership rights in your Content. After submitting your Content, you continue to retain any such rights that you may have in your Content, subject to the license you grant Subaru Canada in these Terms and Conditions. Please remember that you control what Content you choose to submit, and that Content you submit will be available to others using the Subaru Sites, and who may themselves view, share, distribute, access, copy, download, and use the Content. If you wish to delete Content from the Subaru Sites, please contact Subaru Canada at the address set out below with sufficient information to permit Subaru Canada to locate the Content, and Subaru Canada will cease any further distribution within the Subaru Sites as soon as reasonably practicable (however, Subaru Canada will not have any ability to retrieve or delete Content that has been already downloaded and shared by others outside of the Subaru Sites).

“Content” means photographs, text, files, documents, information, graphics, images, videos, sound, illustrations, works of authorship and any other materials (and associated metadata and location information) included in your social media post or provided via email or the Subaru Canada website. For purposes of clarification, “Content” also includes any information (including personally identifiable information) in your social profile accessible to Subaru Canada through social platforms (such as Instagram or Twitter) in accordance with the authorization procedures established by the platform or that you provide in connection with submitted Content.

“Use” means use, reproduce, modify, delete from, add to, edit, translate, create derivative works from, distribute, publicly perform, publicly display and make available.

You represent and warrant that Content posted/submitted is (a) accurate and not false or misleading and (b) does not display any reckless driving or any activity that damages the environment, (c) does not contain profanity, malicious or discriminating language, (d) is not obscene, pornographic, libelous, defamatory, offensive, inappropriate, harassing, or illegal, and (e) does not contain material that violates or infringes on another's rights, including but not limited to privacy, publicity, security, or intellectual property rights, or that constitutes copyright infringement

You represent and warrant that (a) you are the sole owner of the Content or otherwise have all rights, permissions and consents to distribute or post the Content in the corresponding social platforms and to use the Content in any way (including, without limitation, the right to use all names, images and any resemblance to any third party to which reference is made or appears in the Content), and (b) if any image or materials include minors, that you are the parent or legal guardian of the minors. You agree that you are responsible for any rights clearance for any Content submitted by you.

You understand that Content submitted is deemed non-confidential, and Subaru Canada is under no obligation to treat such Content as proprietary information. Subaru Canada takes no responsibility and assumes no liability for any Content posted, stored or uploaded by you or any third party, or for any loss or damage thereto.

Subaru Canada has adopted a Privacy Policy available at: https://www.subaru.ca/privacy that, in addition to these Terms and Conditions, you should refer to fully understand how Subaru Canada uses and discloses personal information you provide to Subaru Canada.

You release Subaru Canada, its affiliates and dealers, and each of their respective officers, directors, employees, contractors, business partners and agents and their successors and assigns from any and all liability with respect to whatever manner they use Content.

You represent and warrant that you are at least eighteen (18) years of age and have the full right to make this agreement and grant the rights set forth herein. You agree to these Terms and Conditions on your own behalf and on behalf of your heirs, personal representatives, successors and assigns.
